Our General Conditions of Sale define the conditions applicable to the sales concluded between, on the one hand, persons wishing to make a purchase via the website http://www.louischevrolet.com, hereinafter referred to as "the Customer" and, 'Louis Chevrolet Watch Company' (hereinafter referred to as LCWC) company located Rue Pierre Péquignat 11, CH-2900 Porrentruy, Switzerland.

The Customer and Louis Chevrolet Watch Company SA being hereinafter referred to as "the Parties".

These conditions only concern non-commercial individuals.

The acquisition of a good by this site implies an unconditional acceptance of the General Conditions of Sale.

Article 1 - Order

1.1 Parcel shipping is done worldwide. Unless spécial restriction.
Orders with destination country Switzerland are to be placed on www.louischevrolet.ch or www.louischevrolet.com. For all other countries, orders are to be placed on www.louischevrolet.shop. 

1.2 The Customer Order is made up of products that are part of the online catalog established by LCWC.

1.3 The order can only be registered on the site if the user has clearly identified himself as "guest" or "client". For this, the Customer is invited to identify himself by indicating his name, his first name, a valid e-mail address, his postal address, and his telephone number. LCWC reserves the right to cancel a customer order that would present in his eyes any form of risk.

1.4 Any order implies acceptance of prices and description of products available for sale.

1.5 Orders are payable in Swiss francs inclusive of VAT for Switzerland and Lichtenstein (all taxes included), in euros including VAT for Europe and in USD for the rest of the world. VAT is adapted according to the country of delivery.

1.6 Our products are sent from Switzerland. All our prices include VAT according to the country of purchase and delivery. In case of purchase outside Switzerland, export charges are added to your order. They represent the handling and control fees charged by the customs services for the importation into your country of a Louis Chevrolet Swiss Watches product. These are indicated in the checkout at the time of your purchase as well as in the summary of your invoice. These export charges are subject to VAT.  

1.7 LCWC agrees to honor orders received within the limits of available stocks of products.

1.8 Gift vouchers are neither returned nor exchanged

Article 2 - Validation

2.1 By validating the order on www.louischevrolet.ch, .fr, .com or .de, the Customer acknowledges having read and accepted without reserve the present General Conditions of Sale on the date of his order.

2.2 Unless proved otherwise, the data recorded by the seller constitutes proof of all transactions.

Article 3 - Availability

3.1 The watch offers are valid as long as they are visible on the site, within the limits of available stocks.

3.2 In the event of unavailability of the product after placing the Customer's order, LCWC will inform the Customer by email as soon as possible. The Customer's order will be modified or canceled if the Customer so wishes and a full refund will be made to its account.

3.3 The availability information provided at the time of the order is only indicative. The products are reserved only after payment of the order. orders payment settled late after the order has been placed can see the stock of the ordered product (s) modified or void.

Article 4 - Delivery

4.1 Delivery method Gift vouchers are exempt from delivery. Gift vouchers are sent by email.

4.2 LCWC commits to respect a delay of preparation between 24 and 48h for a delivery by the Swiss Post, UPS or any other carrier qualified according to the country of destination (subject to a positive evaluation of the payment by Credit Card, PayPal, or Coingate). In case of delay in the delivery, LCWC will inform the Customer by email.

4.3 In case of deliverable items at different dates due to their availability, the delivery time is based on the longest time. LCWC reserves the right to split deliveries. LCWC cannot be held responsible for the consequences of late delivery. In case of delay, an email will be sent to the Customer.

4.4 In the event of a delay of more than 7 days in relation to the expected delivery date, the Customer may terminate the contract of sale and be reimbursed within a maximum of 7 days following its notification.

4.5 Upon delivery of the order, the Customer must verify its content and , in case of apparent non-compliance thereof, notify it by e-mail to the address info@louischevrolet.ch in the shortest time possible.

4.6 When the delivery agent presents a damaged package, the Customer must be able to refuse it.

Article 5 - Selling price, method of payment

5.1 Prices are quoted in Swiss francs, euros or dollars depending on the country of residence or delivery. The choice of region of residence and / or the currency is made at the entrance to the site.

5.2 LCWC reserves the right to change the price of the items at any time.

5.3 Items and additional fees will be billed based on the rates in effect at the time of registration of the order.

5.4 Retention of title clause: the products remain the property of LCWC until full collection of the amount.

5.5 VAT according to the country of delivery is included at the end of the order process in "amount to be paid", only for guest and client who fill the form with the country of residence 

5.6 The payment of articles online is made by wire transfer, credit card, Paypal, Twint (Switzerland), Alma (Europe). Accepted credit cards are: Carte Bleue, Visa, Eurocard, Mastercard.

5.7 LCWC makes every effort to ensure the confidentiality and security of data transmitted over the internet. All data exchanged on the web is encrypted. The payment is completely secure.

5.8 Purchase by invoice with partial payment option (POWERPAY) As an external payment provider, MF Group/POWERPAY offers the payment option ‘Pay by invoice’. You can simply pay for your online purchase by invoice using the order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview. When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it using the payment method selected. By selecting purchase by invoice, you are also agreeing to our GTC, POWERPAY’s GTC. (powerpay.ch/en/agb).

Article 6 - Satisfied or refunded

6.1 Order error: In case of model or article error during the order preparation, LCWC agrees to exchange the article. Return fees will be the responsibility of LCWC.

6.2 Return by the Customer: The Customer has a withdrawal period of 14 days from the date of receipt of the items. Return costs incurred by the customer are not refundable. Upon receipt of the package, LCWC will judge the perfect condition of the items. No returns will be accepted if the returned products have been visibly worn, damaged or their packaging damaged, rendering the product unfit for resale. If the return is refused by LCWC, the items will be returned to the Customer at the expense of LCWC without the Customer being able to demand a refund or any compensation.

6.3 Reimbursement: In the event that LCWC performs a product refund, it will be made by crediting the Customer's bank account within a maximum of 14 days from the date of notification of the refund. LCWC may, however, defer repayment until the goods are recovered. LCWC will then reimburse all amounts paid as part of the order, including delivery charges if they have been invoiced.

6.4 Gift vouchers: Gift vouchers are neither returned nor exchanged.

Article 7 - Warranty

7.1 LCWC undertakes to repair or replace any item with hidden defects or quality problems during normal use of the product, within the framework of the 2-year Legal Warranty and the Manufacturer's Warranty (2 years minimum). For optimal processing, any return request must be announced to the LCWC customer service department by email at the following address: info(at)louischevrolet.ch. The return costs are the responsibility of the Customer beyond 30 days after receipt of the order. Return shipping costs are the responsibility of LCWC. Any return under warranty will be imperatively accompanied by the Certificate of Warranty or a copy of the purchase invoice.

7.2 In general, the warranty covers manufacturing defects that occur during normal use of the product. This excludes therefore: the replacement of consumables (battery, straps ...), damages caused by abnormal or improper use of the products. We invite you in this regard to carefully read the instructions for use supplied with the product damages due to the intervention of an unauthorized repairer, damage resulting from a cause external to the product (accident, shock ...).

7.3 It should be noted that the duration of the manufacturer's warranty may vary depending on the model. The extent of a product's warranty is detailed in the warranty certificate accompanying each product.

8- Liability

8.1 The products offered comply with the Swiss legislation in force. The Customer cannot be held liable in case of non-compliance with the legislation of the country where the products are delivered. It is the Client's responsibility to check with the local authorities the possibilities of importing or using the products or services that the Customer intends to order.

8.2 Photos are provided for illustration purposes. LCWC therefore invites the Customer to refer to the description of each product to know the precise characteristics. In case of manifest error between the characteristics of the product and its representation and / or the conditions of the sale, LCWC cannot be held responsible.

8.3 In case of hypertext links pointing to other sites from the LCWC site, it will not be responsible for the content of the information provided on these sites after activation of these links.

8.4 LCWC may decline all or part of its responsibility by proving that the non-performance or the bad execution of the contract is attributable, either to the Customer, or to the fact, unforeseeable and insurmountable, of a third party to the contract, or to a case force majeure.

Article 9 - Applicable Law - Litigation

9.1 This contract is subject to Swiss law. In case of dispute the Swiss courts will be competent. The French version of this contract prevails over all translated versions.

9.2 This contract is written in English.

Article 10 - Commentary, Criticism, Communication

10.1 All Customer Submissions are monitored and moderated by the LCWC Team. Since the statements violate the law and ethics (abusive advertising, defamatory remarks, insults, and comments out of context ...) LCWC reserves the right to refuse or modify the notice concerned.

Article 11 - Ordering a product for use outside Switzerland

11.1 The Client must take into consideration that, in the context of the relocation of an order or product to a country other than Switzerland, he remains the importer (or the intra-Community purchaser) of the products concerned. Customs duties, local taxes, import duties, or state taxes that may be required are under his responsibility. The Customer must inform the local authorities of his residence on the conditions of entry of the products ordered and must make any declaration and / or corresponding payment to the competent bodies of the country concerned.

11.2 The Client must check with the local authorities the possibilities of importing or using the products or services he plans to forward. The Customer must also ensure that the technical specificities of the manufacturer comply with the legislation of the country concerned. If the Customer does not respect the legislation of the country where he has introduced the products, we cannot be held responsible.

Article 12 - the order has been paid with a Gift Card

Gift Cards cannot be exchanged, credited to a card or bank account, or discounted. They are not convertible into money and will in no way give rise to the refund of a difference in value between the price of the goods or services purchased and the amount shown on the Gift Cards. Products and / or services purchased are payable in cash.

Article 13 - Assistance and complaint

For any question relating to the Site, the products sold by LCWC and for any claim relating to an order, the Customer is invited to contact LCWC by email at the following address: info(at)louischevrolet.ch, with its order number at the time of delivery. Once confirmed, LCWC will endeavor to respond to the Customer within a reasonable time upon receipt of the request.

Purchase in cruptocurrencies:

Special Conditions. Please note that the purchase in cryptocurrencies rate may change between your purchase decision and the purchase confirmation by Coingate. Louis Chevrolet Swiss Watches can under no circumstances be held responsible for variations of the cryptocurrencies price. In case of refund, this will be made exclusively in Swiss Francs (CHF). The reference amount is the one paid in Swiss Francs CHF at the time of the order.
